Do I really want to touch this?
Oh go on then.
I've had a modicum of experience through having to rely on the civil court system with regard to my children.
I can't really go into details, but what I can say is that from my experience it is an entirely fair and thorough process.
Judgement is made based upon the facts presented.
Allegations and counter allegations may be made, but the court will seek to depend on factual evidence - which can be used to prove or disprove an allegation.
In some cases, expert witness are called upon.
When making a Judgement, the Judge must also consider the relevant legislation.
I have to say that while I wasn't entirely overjoyed with the final outcome, given the evidence and the account and recommendations by the experts involved, I can honestly say that it was a fair outcome and looking at it objectively, was the only possible and logical outcome.

The legal system we have appears to be fair, ok it can be manipulated, but at least money doesnt have as much effect as it does elsewhere. However it is the sentencing that needs looking at. |

It is fit for purpose. Mostly it works, sometimes it doesn't.
It isn't all about the legal system, a lot of it is about the person going through the legal system.
I deal with criminals on a daily basis. Some you know are going to continue going through the system like a roundabout. Others are on it for the one ride and will never get on again. |

I am afraid that it is not possible to have a perfect system. It involves legislation and human judgement. It is subject to financial pressure like all resource. All in all, it does a reasonable job and is a lot better at it than many other countries' systems. But I think too many people call upon the principle of justice without considering its implementation. |
