Not sure we can - was supposed to go back because the ratchet had broken, but surely they will just say - It should not have been left open'??
Now it has sheared off and cannot be closed as the mtalk has splayed, so we will have to mangle it severely.

I'd still explain to the seller that it wasn't fit for purpose when you bought it and see what compromise they are willing to come to with you. |

you have the right to take it back- exchange or refund if not fit for purpose intended - you may have to do some convincing due to its accident tho |

Well I have just scored grade A on my metalworking skills with a pair of pliers and managed to get it collapsed without too much of a mess, so will take it back.
