I got one the other I broke over a week ago
So in plaster and still able to perform in every way of life just a bit inconvenient with some of the kinkier stuff !
My hardest problem really is, is it actually wrong to go on holiday while off sick... feedback suggests it is taking the piss from other work colleagues.
Not that bothered just thought is an oppurtunity but are there any implications legally or otherwise ??? |

If you are unable to do your job whilst in plaster don't think it's a problem you going on holiday. But have a chat with your boss and seek their view on it.
Try community legal advice, it's free, and they are very good with employment law. You will find details in yellow pages.

Personally id be a bit pissed off if someone was off sick but went on holiday however, one could say that it was for medicinal purposes if holiday was already booked, fine but otherwise, im in agreeance, seek advice first |

there should be no problems with having a holiday, if your injury states you can not work, then you can not work, but does not mean you can not go any where, yeah sure if you were just full of a cold/flu etc then no a holiday is not the answer lol, you can always put it down as stree relief which any doc will tell you to get of the house/holiday |

It is not illegal to go on holiday while off sick, you are however under employment law required to be able to be contacted by your employer while on sick leave.
You are required therefore to inform your employer that you are not available to attend your place of work for interview or appointment with your employer during your sick leave, you need to be honest with your employer on this. They cannot legally refuse you but they can legally expect to be informed of your plans.
The problem may lay with holiday pay verses sick pay for this holiday period, as employers cannot legally ask that you take part of your sick leave as holiday anymore since the EU ruling of 2008.
So inform them or risk your employment. |
