mobile phone contract

so i just changed service providers last monday, got a pac code and took my number with me that i have had for years, i am now not happy with my new provider for a few reasons and would like to go back to my old one.

only been with the new provider for 6 days

my question is, do i get a cooling off period? and will i be able to cancel and go back to my old service provider without any penalties?

I'm not certain but I seem to think you do get some sort of cooling off period, I seem to think it would be 7 or 14 days.

If you bought it in a shop then no. If you bought it online or over the phone then you have a 7 day cooling off period due to distance selling regulations.

Check the law for your area, as well as the contractual terms that you have agreed. If you present a reasonable case, even without any terms that permit you to cancel, they may permit you to alter things.

I actually don't have a contract phone. I only use it a bit (but nothing mad) and don't really pay anything for it. It's brilliant tbh.

A sufficently good smartphone is only £100 these days (Moto G at the moment).

Same for me, but galexy ace on 3PAYG here...

Been with them from day 1, 3 phones in in 12 years total cost less than £200 and 3 or 4 £15 top ups a year.

I had a similar issue 2 weeks ago, luckily my number hadn't yet been transferred, one of the reasons I cancelled, I was told if it had gone through I'd loose my number. No idea why that should be the case though.

Car phone shoppy, give a 14 day cool off period, luckily!

I was pay as you go but changed to contract about 9 months ago as it sounded cheaper. Cant wait for it to come to an end so I can go back to PAYG. Turning out to be a lot more expensive

What? it was a genuine question. The terms relevant to the OP's contract will be specified in there.

Much more accurate than asking people to take a random guess.

I'd think the sale if goods act applies so the service must be fit for purpose.

If you don't get a reliable signal in your area, for example, I'd say you have grounds to end the contract, especially so soon.

All networks have a clause that prices may go up during your contract just like many utility companies. The increases are due to inflation and tend to be very low as it's a competitive industry.

If you are not getting the correct amount of minutes, text or data or the price is different (pre-increase) to what's on the contract then it has been missold and you should be given the option of cancelling it

If you haven't signed up with anyone today may I suggest that you have a close look at 3. I've been with them for 10 years now and have never had a problem with them, in fact I have found them really helpful in all my dealings with them. Also work out how much your bills would be if you had a PAYG phone you may be surprised at how much you can save.

yes. 3 are very good, was with them since they started (until the last 6 days with O2) never had a problem with them and intend to go back to them tomorrow.

last cpl of years been on a sim only contract and at the mo they are doing a fantastic deal sim only with more mins/texts/data than i ever use (500mb 200 mins and 5,000 texts) for £6.90 a month, 12 month sim only contract. which is double what i was getting from O2 for £8.50, also O2 were charging 35p to retrieve voicemail, its free on 3, and as i remember, free 3 to 3 calls.

also, as soon as i signed up to O2 last monday on an £8.00 per month contract, they text me to say the price was rising in their yearly price rise and my bill would be £8.53 which included my pro rata monthly billing

wtf is pro rata billing??

i'm sticking with 3, i know where i am with them

3 dont have great coverage but i have changed from orange to 3 and now pay 12 for more minutes andtexts than i could use plus unlimited data plus tethering on sim only.. battered them down from 25 pounds cos the coverage is so poor in my work area, so now im happy enough

I've just moved to 3 from Vodacrap £15 3,000 mins 5,000 texts unlim internet and tethering and AND 4G for no extra and I get 4G Now @ 16meg thats 3 meg faster than my home broadband

actually thats is not true anymore.....

It changed at the beginning of february and I was going to put up a thread about it...

OFCOM changed the rules to mobile phone contracts where they said that if there is an increase in the price after the first 30 days, they have to notify you in writing.....

then you have the right to walk away from that contract with no penalties within the next 30 days.....

they may ask for the actual phone back (because it is subsidised based on the actual contract) but that is a small price to pay to get out of the contract....

Dont want to either rain on your parade or contradict you, but I believe that you are about 8 years out of date. Orange piggyback their service on the 3 network in the places they dont cover...

Prior to Orange it was O2 that used the 3 network piggyback to get full country coverage because 3 are the only company that have total G3 coverage (no doubt there are some places that still do not have a signal but I expect you will need a satellite phone in those areas).

Let me add on a little bit... So it doesn't now matter if you are in month 2 or 12 or 22 of your contract... If the price goes up, they have to notify you in writing, and then you have 30 days to walk away if you want to

You only have the first 30 days after they notify you of increase to get out.. After that then stuck

I suspect that it would have to increase by a certain percentage for the customer to be able to cancel immediately. I know for certain that one network still has it in the terms and conditions that prices may go up but if they go up by over 10% the network contacts the customers affected to advise them that they have the right to cancel.
