Adebolajo is appealing his conviction...
Hasn't even been sentenced yet, so I'd assume he will also be appealing his sentence once he receives it too.
No doubt he will be using taxpayers money in the form of legal aid to fund his appeals.
Whilst it is his right to appeal, with I hope no chance of success, it does seem that he is using the legal system to gain notarity rather than a realistic chance of being judged to be innocent.
I know we're supposed to be the who take the moral high ground and to respect everyones human rights and that on the grand scheme of things his appeal costs are not a sizable dent in the economics of this country I resent the fact that even a tiny fraction of my tax paid in is subsidising this persons appeals.
He has had his fair trial funded no doubt by the legal aid system, how many publicly funded fair trials do we have to give someone. There have been mistrials in the past and probably will be again in the future, having the whole incident on film does seem to make a clear cut case against these two, there can't be much doubt in anyone's mind that in this case the convictions are sound. |

When you abide by the Rule of Law you can't pick and choose who gets it, or which bits you abide by.
No matter how guilty someone appears, how heinous their crime, how low their chances of success or their motives for using all of the legal remedies available, rights are rights and once you start restricting them for some, you enter a system that is far more arbitrary. |

this..
and no doubt there will be those in the legislative who say there should be restrictions on whom and for what type of crime 'our taxes' are used etc..
its a slippery slope as once its in its only those who have the private means who can afford justice..
personally i dont like my taxes being spent on cluster bombs but thats democracy.. |

Maybe he should fund his own appeal(s) though? He has a family that could try and raise money for him.
Off topic see you at BNO I think you're going to be easy to spot... |

they have that in Korea..
personally i would much rather that the police had at the time they murdered Lee Rigby shot them both fatally but that didnt happen ..
so the police treated themat the scene, which in itself says more about us as a society than many things..

which applies as it does to folks wrongfully convicted who 20 years later are rightly freed..

No offence but have to disagree about the police fatally shooting them.
To deny them martyrdom ect and keep them alive to face the full force of the law was a good call IMO.
Will be interesting to see the sentences they are after the appeal for longer life sentences goes through. |

Cluster bombs are now banned and the UK has destroyed most of its stockpiles.
I know there is a need for appeals and retrials and that we cannot limit them to certain people, but surely there should be some reason for them, such as (hopefully overwhelming) new evidence. As far as I am aware there is none and he just wants to go over the same trial which I believe will end up with exactly the same result. Do the defence not have to produce something new to give the appeal some chance of success?
No doubt when he gets sentenced he will also be appealing against the length of the sentence also.
Does the appeal go through another jury trial or will he be in front of 3 judges who will decide? Although no doubt the solicitors/barristers will still be making lots of money from it.
It's only been 9 years since the double jeopardy law has been rescinded for serious crimes, so the governments right of appeal has only been in existence for this time.
If he appeals his sentence when he receives it we can only hope that the appeal judges double the sentence for being too lenient, this person should never taste freedom again until he is carried out in a box. |

"Because an appeal is lodged as far as I'm aware it does not mean it will be heard new evidence etc must have come to light "
That sounds more sensible, it just seemed to me that he is appealing for the sake of appealing with no realistic chance of success, which is a waste of our money which I'm sure most people would rather see spent elsewhere. |

Whatever judge sitting will make a quick decision that there is no basis for appeal and that will be that. |

An appeal can be made on two points.
1 - the length of sentence, ie, it is outside of current sentencing guidelines,
2 - on a point of law, such as a misdirection from the trial judge.
Before an appeal can proceed, leave must be gained, so there is no automatic right to appeal. |

I would like to hear what they are thinking. Find out who educated them and why they did this.
I don't know what these extremists want. Do they want us all to become Muslims Because that ain't ever going to happen!
To carry out this act takes a very twisted or brain-washed mind .
I'm all for the death penalty in certain cases like this one but why did it happen in the first place? |

His defense of being a soldier at war should have been allowed...
Soldiers who out of uniform while in combat loose all protection in international law and are subject to summary execution. Let him have his appeal then take him and his mate out and string them up! |

Who cares? Far quicker to puff out your chest and become indignant than it is to carry out any kind of root cause analysis.
Plus, if you took away the more warped aspects of fundamentalism, you might find that they had a point about America and Israel's (hiding behind America like a child every time they get in trouble with the UN)influence in the Middle East. |

My point is that if we can find why they are carrying out these attacks or who is training / telling them to carry them out we can possibly avoid it happening again.
After they have the information required then execute them and do what the Russians did a few years back after a Muslim attack, bury the bodies wrapped in pig skins which I believe us one of the biggest insults to a Muslim !! |

A fair proportion of UK political leaders are supporters of Israel, the group is called 'friends of israel'
The formation of Israel has caused a long term problem that isn't going to go away.
Can you imagine if we had let them take (for example)75% of Wales as a homeland instead of Palestine... Any US government that doesn't support Israel will not last in power due to the voting power of the bible belt. I've read up a bit on Palestine to try and work out for myself why it is a problem area and it seems to me that the Palestinians have over the past few thousand years received the shitty end of the stick. They cannot hope to face off against the west or the nations such as Israel on a level playing field so they turn to what we consider to be terrorism. Depending upon what side of the fence you sit on, one mans terrorist is another mans freedom fighter. I'm fairly sure when we pull out of the middle east the same problems will return. Europeans have slaughtered millions of each other in fairly recent history, and things are now fairly stable, maybe it's time to sit back and let the middle east sort themselves out like the europeans have, however distasteful that prospect seems. |

I'm well aware of the difference, I was pointing out that perhaps it would be wise to be careful. What the Israelis are doing to the Palestinians is an atrocity; not all Jews are Israelis or pro Israel |

Some of the opinions about his right to a fair trial or appeal or how he should be punished truly disturb me and seem to endorse the regime of Countries like North Korea.

Shouldnt be allowed to appeal, the evidence was over whelming.
However, it does give the chance to increase the punishment, and cut a few finger tips off, remove and eye, pull a few teeth out, that kind of thing.
Im not doing anything next Tuesday and happily offer my time and surgery skills to the relevant departments |

"When you abide by the Rule of Law you can't pick and choose who gets it, or which bits you abide by.
No matter how guilty someone appears, how heinous their crime, how low their chances of success or their motives for using all of the legal remedies available, rights are rights and once you start restricting them for some, you enter a system that is far more arbitrary. "

Israel, not Jews, was bought into the conversation because they're a major contributor to Middle East stresses and confrontations. The scale of the atrocities carried out by Hitler against Jews wasn't in question. The behaviour of Israel towards Palestine was. There are comparisons to be made.
As for their presence in this thread, that's how debates develop. That's how the other thread got from Jim Davidson to Napolean.

At the end of the day it's not this crazy man who's appealing it's his lawyer and that's so he/she can screw more money out of the system.
If the appeal lasts a week at £500/hr or whatever they earn can you blame them?
Psycho Muslim extremist whatever you want to call him expected to die that day so the last thing he's thinking about is the appeal process. |

Unfortunately in these situations people who are afraid of those who aren't the same as themselves. They feel that people who don't have the same beliefs as themselves are going to try and convert them, or poison them with their own views. I am very much a Jew by birth and not by belief, but my heritage is important to me. I work in a Muslim community and have affiliations with a local Muslim education centre.
As I said previously in the thread, there are good and bad in each and every religion, there are extremists in each and every religion, there always will be and there always has been. But when people stop being afraid of others who are different from themselves then a lot of these preconceived ideas will dissipate. Sadly, I don't see that happening any time soon. |

"unfortunately its the law that anyone has the right to appeal id hate to be his lawyer "
I was thinking exactly the same. Whoever got that case must have had their head in their hands!
I think the way the police acted saved a lot of trouble in court, everything seemed to be done by the book.
Being ex Army I was devastated by what happened but similar things have happened before and the justice system has got to be seen to do its job.
These 2 will get there just deserts in prison (proper justice given out by inmates always seems ironic to me)
Hasn't one of these two already lodged an appeal and had it kicked out in minutes or am I thinking of someone else.

The issue of representation is an interesting one, far as i know everyone is entitled to a defence in our courts..
child murderers have and will be, accept its not a case that an advocate may well leap at but the process has to happen..
justice must not only be done, it must be seen to be done or something along those lines..
imagine a scenario whereby the court of appeal finds that as defendant convicted of one of the most disgusting and heinous crimes was an unsafe conviction as the advocate was remiss or failed due to inexperience to represent the defendant to the best of their abilities..
cue a retrial, more anguish for the family etc.. |

Very early on in this discussion I made a point it seems as though everyone has either missed it or is just ignoring it...
The fact is in his trial he claimed to be a soldier fighting a war. There are very strict rules about what soldiers can and can't do and amongst them is a very strict rule that says soldiers must be in uniform when in combat and any soldier not in uniform who engages in hostile acts looses all protection and is subject to to summary execution. I suggest that they have no rights in law and should be allowed reclaim their military status and then treated accordingly. |

everyone has rights 'in law', its what seperates us and our system from the types of people the extremists want us to become..
he was'nt or is'nt a soldier and as such cant be treated along the lines of which you suggest..
a soldier ie a member of the armed forces of a foriegn state is protected by the Geneva convention as are ours when engaged etc..
accepting that he was a soldier gives credibility to the radical extremists, they are not and should not be afforded such status..
any tom, dick or harriet could claim the same..
he is a murderer and will be banged up for a very long time.. |

Funny that, seems that the UN and international law would not agree with you...
Its the reason that the US deem insurgents as illegal combatants and are not being held to account in the international courts for their aggressive kill policies. |

Are you really quoting what Uncle Sam does as proof of international law? |

"Yawn.
That was a constructive and insightful contribution to the discussion "
No, it was a yawn, which given the general tone of the thread was all it deserved.
Perhaps next time I'll get all "Outraged of Tunbridge Wells" on yo ass, but not this time. |

Dear Mr Chancellor of the Exchequer,
Can I have some tax-payers money for a new Blu-Ray player that also plays SACD's and DVD-Audio discs please as I need to rationalise on the amount of boxes sitting under the TV.
Regards,
Mr. JFL"
I'd approve your request - just on the ground of someone mentioning SACD and DVD-A on Fab! |

DVDA gets mentioned fairly regularly but not DVD-A SACD? Never seen it mentioned! |
