England soft on crime?

Figures show criminals are twice as likely to be given a custodial sentence in Scotland than south of the border. 8% banged up in England whilst 15% banged up in Scotland. So is England soft on crime or perhaps the Scots stricter?

The prisons are full there is no where to put them. Hence other methods such as asbos ant trackers etc. But I'm not sure how effective they are

I dont think stats alone can even begin to look at this.

How many were re offenders, what were their family/private circumstances. What lead them to the event. Which judge.

Prison space, 'public demand' priority, cost, plea, it's why ruling by consensus would never work and it's up to a judge or panel of 3 to decide the individual's consequence of the action.
