Hi guys/admin- quick question… what is the site policy in relation to cyberflashing? This is a sex site, so surely this doesnt apply for fab?x

Honest and genuine question- just because if it applies, people should be made aware to stop unsolicited images? X

Cyberflashing rules apply anywhere where UK Law applies. Including here. Unsolicited PM messages with nudity etc technically are cyberflashing yes. Accessing the site and seeing nudity is not cyberflashing because you are actively choosing to access adult content. It's the unsolicited nature of images/videos where it's an issue.

Just because it's a sex site doesn't exclude it from the law! Yes you expect to see some explicit images.

Photos we chose to see on profiles are very much different to having them spammed in a private inbox where they aren't asked for, if not consented to then privately messaging someone your cock is cyber flashing.

As we've agreed to see adult images I suspect not as we have the option to hide them if we so wish we've chosen not too, however that doesn't hide explicit pics in messages.

This is from a law firm.....

Cyberflashing is the act of intentionally sending someone an unsolicited sexual image from your device to another person’s device, without their consent. This can occur via social media, Bluetooth, AirDrop, or any other electronic means.

You must intend for the other person to see the genitals and be caused alarm, distress or humiliation. Alternatively, you can be guilty of this offence if you send the photograph or video with the intention of obtaining sexual gratification and are reckless as to whether the recipient will be caused alarm, distress or humiliation.

Cyberflashing is an either-way offence with a sentence of up to 2 years imprisonment.

Is 'here' Device to Device ? 'Does it come from your comp to my comp ? Seems to me it comes from a website ..... and not device to device

The 'offender' couldn't send if you weren't on here ...... so it's not device to device as such....

If you are browsing the forums there is a certain level of expectation that some people will have nudity in their avatar. Likewise, there is a certain expectation that nudity will show up in your searches.

Receiving unsolicited nudes from strangers that you haven’t interacted with is completely different.

If you send it from a device and is recieved by a device it doesn't matter if it was air dropped, WiFi, Bluetooth etc etc.

It still goes from device to device.

Most people on here won't be sending pictures hoping to cause alarm, distress or humiliation. They're doing it to try and get you interested for sex.

I admit some photos might cause alarm, but is that due to the recklessness of the sender? Maybe for some extreme photos. But generally most pictures of an erect penis seem unlikely to be classed as cyber flashing.

The Revised Act makes clear that the crimes are punishable and : intent , harm , sexual gratification, distress , humiliation etc are now erroneous...... it's do it and die..... it's punishable on it's own.

The only time we will get a definitive answer is when someone from FAB is taken to court and a ruling is given.

We can all read the laws and say how it should be interpreted but a Judge making a ruling is where it actually gets real.

Fab has the option to hide all explicit images so I’m not sure. The defence could be that you joined Fab (knowing what the site is) and chose not to click the “hide all explicit images” which is the equivalent of an adult safe search button when setting up your profile, so therefore you actually consented to having said images be viewable to you because you did not actually consent NOT to have them viewable. So not sure there would be any argument as to the profile pics.

Sending/receiving them will of course be different.
