I didnt want to hi-jack the car bump thread but this happened to me last week.

i received court paperwork through the post for a private claim against me for a car accident over 12 months ago. My insurance in January this year had told me that the claim had been closed because the other party's insurance had not pursued it. So i had thought no more of it.

Until this document arrived giving me 14 days to put in my defence - and if you think £500 was expensive for a bumper, they were claiming £4500 which included over 3k for the 'reduction in value to his 2010 car', solicitors fees, court fees and interest!!!! There was only a small dent to the passenger door!!!

I eventually managed to get hold of my now previous insurance company, and wanted to know what they are going to do about it - the solictor named on the court document is the other parties insurance solicitor!

So it would appear they wait for the insurance claim to close and independently sue the individual! its a scare tactic and if i had called them, they would have allowed me to arrange a payment plan with them !!!

Over my dead body - i wouldnt have thought this would have been allowed !!!!

i am still waiting to hear from my insurance company to find out if it has all been dealt with - they said they handed it over to the solicitors and not me not to worry

That's absolutely despicable!!

I'm not going to use all the words I'd like to use to describe them...

Hope your insurance tell them where to shove it GTG xx

well it arrived on Friday of course when the offices were closed and i did have a major stress out and cried - apparently its a scare tactic that they use quite often !!! i think my most commonly said phrase that weekend was 'but I have insurance'

And this is what you pay an insurance company to deal with.

All the added extras/services included in the policy, leave them to deal with it.

Case is closed with no injuries claimed for whilst it was open I doubt they will get far.

I'd file the letter in the bin

I’m not sure I understand what you mean here.

You had a bump and went through the insurance, the other party didn’t take it forward and the case was closed.

You received court papers from who? The owner or their insurance company?

(If I’m honest this is sounding a bit like a con)

You say it’s a scare tactic, what are they trying to scare you into? Settle out of court for a lower amount?

You will be surprised how many cases insurance companies lose, mainly by not turning up to defend themselves.

Contact the fca ombudsman. They don't take things like this lightly and are all for protecting the consumer from anything misleading from insurance companies and their products.
