In which sense?
It is consent implied by a gesture. Like asking someone if they want a drink, implied consent could be a nod, or thumbs up.
With more serious things sex being one of. Implied consent shouldn't be a thing. People have additional needs and social struggles which means anything beyond a clear "yes I want to have sex with you." Is to gauge |

"If I have have spent the night getting down and dirty with a guy and we fall asleep then I assume he is OK with waking up with his cock in my mouth "
I would consent to that |

By being present in a swingers club for an event, I consider that implied consent to see things like me fucking someone. Anywhere else I do not assume that consent, and will not have sex in any public places where that is the case.
But I don't feel the need to ask every person in the club before I start sucking some dick if they are okay with seeing that. Just the people who's dicks I want to suck. Because that, like most direct things, needs absolute consent |

Would this be the same if a woman woke up to find a man's dick inside her?
Seems problematic. |

I make it very clear to anyone staying overnight that I am absolutely not down for morning stuff, because that assumption can go wrong |

I think it’s a term that is used to try and justify someone having done something that they probably shouldn’t have.
It is used in situations where basically people have taken the piss by being granted permission to do something and then just expanded the remit.

The only time I believe in implied consent (other than Prey’s)
Is first aid. If someone is not breathing etc and needs first aid then consent to save a life is implied. Until they regain consciousness and either refuse or consent. |

Was just about to say the same thing. same if they are bleeding, by coming to you and making you aware they are giving consent to be treated |

Not exactly.
It's commonly used in a lot of areas. At events (general, not swinging) there'll be signage up to say that the activities, show or performance may be bening recorded and that by attending you're happy to be filmed/photographed. Of course the only option if you're not is not to go, but its the only practical way for things to be recorded.
Likewise in healthcare. Unless a specific DNR notice has been filed doctors and nurses will attempt to sustain life. Paramedics may not have access to that information so have to work on implied consent unless notified otherwise by next of kin.
It's also a common aspect of UK law, but that's when things get very situationally specific. |

I’m sure it has a specific legal definition but I think in everyday terms it’s like so many other terms that get used out of proper context to simply justify something. |

No doubt at all on that. But it does have some very necessary uses too. |

Personally I don't think it ever should be. I'm sure it has by some lawyers though. |

I mean.
I quite often don't actually say the words "I would like to fuck you now, are you okay with that?"
Or "Yes please, I would like the sex now."
I suppose I do occasionally ask "Please may I ch0ke on your dick now?"
But technically a lot of my encounters run on the implied consent from the actions leading up to it. The actual words aren't always there, which means the consent can only be implied. But also I know my partners or I would stop immediately if there was a clear indicator of non consent. |

They're seems to be differing opinions on what implied consent is.
If your gestures and body language are positive and encouraging. That is consent. It's not just words that signals it. Nothing implied there. It just is. |
