I realise this is a bizarre place to post this but you lot know everything so someone should be able to help

I have received a fpn (correctly addressed as in property but not person)

As it is not in my legal surname do I have to pay it straight away or can I "demand" (legally) that they amend the order showing the correct surname? Its not something I've refused to pay BTW its something I'd prefer to pay when the correct person has received it

Tried contacting them to no avail for nearly a month now

Why would you have an issue with an incorrect name , but not your real name, surely it’s beneficial to you next time you get caught

Because school are telling me I still have to pay. Irrespective of name. And I believe if legal documents are sent incorrectly addressed then it's not mine to pay

I would advise that you seek proper legal advice for this.

However, on a superficial and cursory basis, I would say that you're better off paying the fine first and then appealing to have the document changed to the correct name. This may keep it from escalating to where you'll need to pay more or the case progressing to court.

If you know you have breached rules that have resulted in the fine, then surely it’s less hassle to pay up. And the lodge the correct name details with the school.

Need a bit of context around the incorrect name. Is a spelling mistake or a change if surname through marriage/divorce….

if it was delivered in the mail, and it was not you actual name, then i believe it is illegal even to open it. so how could you possibly know there is a fine inside? if you get my drift.

I had a fpn for parking. They got a letter wrong on my registration. They had a picture of my car with the correct registration.

I appealed and they said due to it being a mistake there end I didn’t have to pay.

Don’t know if this helps any.

I also know someone who got a tax rebate in there unmarried name they cannot cash the cheque even though they are the same person.

How can you pay something that is not technically yours to pay. They cannot take you to court as that person does not exist.

Knowing the courts if they cock it up they will say get your facts right then we might listen to you. You are the authority in the matter so you should get your facts straight.

Tricky one... Maybe ask citizens advice? Or there's a legal advice group for the UK on Facebook.

Usually, it needs to be in your legal name, for it to be legal (for example my friend, changed her name and her tenancy agreement was no longer valid/legal).

But if you know it's definitely for you, and you need to pay it, you need to pay it.
