"I mean, you sign up to a sex site. There is nakedness everywhere and on your own profile. I always find it amusing how so many people hate dick pics. " This is sort of why there is chance it may not apply here, legally at least. Nakedness and nudity is part of the site. While the private unsolicited dick pics is still a thing, it may not transfer as such due to the nature of the site.

"Is a profile pic with a dick in it an unsolicited dick pic?" The law relates to the 'sending of' and I suspect that's the crucial bit.

"I'm sure this will be covered in the t&C's! You think T&Cs would override the law of the land?" Rewritten T&C will probably indemnify FabSwingers.com against any liability. Well written ones will likely say that by being a member of this site, you waive the right to bring a complaint against the site or its members for receiving unsolicited adult content. In much the same way that most employment contracts now include a waiver of working time directives.

"I'm sure this will be covered in the t&C's! You think T&Cs would override the law of the land?" I mean, it's a tad frowned upon to bend over and gape your asshole but people.get away with it on here. Other non sex related sites, in public, going about your normal day, yeah , then it should be illegal. And it is, that's good. I just think, as an adult, joining a sex site, looking for sex, posting provocative pictures, writing provocative things, it just seems a tad off throwing a hissy fit over a cock pic. You can just delete, block, never have to see again.

But if the law classes fab as a pornographic site, not a social media one, which I expect it does. Don't be surprised if that's the case. You come on here knowing there will be nudity. Private messages won't hold the same weight as on other social media platforms if that is the case.

"I suspect this would require a test case. Somebody on here would have to report an incident to the police and the police would have to investigate and get the identity of the perpetrator by getting the site to divulge the phone number they have registered with. If they take that seriously enough, they would take it to the CPS who would decide if it's in the public interest to prosecute and then go to court. I suspect that on a swingers web site it wouldn't get that far. It may not even get off the ground. The police have their hands full already. This is aimed at a different group. So even if it is technically illegal on here, I can't see the authorities taking it seriously. " Yes, agreed. Would be interesting to see what happened if one was reported. It may well get a different response depending on which authority deals with it.

"I am trying to find the full wording of the Act. It will need a read to understand the full implications" States this as part of the act: Other new offences have been created, including cyber-flashing - sending unsolicited sexual imagery online - and the sharing of "deepfake" pornography, where AI is used to insert someone's likeness into pornographic material.

The entire premise of such site (categorically) is that you will see genitalia - victim blaming or not it is the nature of such a website. And this is likely what the law will view - pornography site. On a social level you are right, but lawfully unless it's made specifically clear thatit applies to any and all private messages regardless of site type it won't be impacted regardless of unsolicited or not.

"If this came into force on Fab, I can see it being a reportable offence and a site ban as a result. Would it be such a bad thing? I don't think it would be." Bad? Not at all. For the most part I myself am looking at it logically though. And unless it's worded in a specific way there is a big chance that it won't apply to fab because laws need to be worded in very specific ways. Fab itself falls in to an overlap, it's pornographic but also social media. There is a chance unsolicited may not apply to porn sites, which would make sending of such a none crime.

The law may not apply that to pornographic sites. It all depends on the wording of the law. Pornographic sites may fall under a case of you entered the site knowing genitalia will be seen regardless where. I'm not say that will be the case but because of how laws require very specific wording to work, I'd not be surprised if it won't apply here.

"Under the proposed legislation announced on Sunday, anyone who sends a photo or film of a person’s genitals - "for the purpose of their own sexual gratification or to cause the victim humiliation, alarm or distress" - may face up to two years in prison. You might be alarmed or distressed, but you would have to prove that they intend to cause alarm or distress. As this is a swinging site you would be very unlikely to. " You are reading it wrong. You'd have to show intent to cause alarm, distress or humiliation, OR you'd have to show sexual gratification and recklessness as to whether A, D or H wad caused.

Woman has status "mmmm so wet and horny" Man thinks hey up we're in here, sends quick "wow babe you hot, want this?" Or prosecute a death row inmate for murdering another inmate? The law is the law." I’d say probably not. Prosecutions only get through if it’s got a good chance of conviction and it’s in the public interest. Sending a dick pic on a sex site 9/10 times is presumably done to try and entice someone to have sex with said penis. I don’t think you’d be able to prove an intent to cause distress

It's just another example of users not respecting another's preference. Just use common sense, delete the message and move on, Mrs xxx" Don't start with common sense on here!

"I mean, you sign up to a sex site. There is nakedness everywhere and on your own profile. I always find it amusing how so many people hate dick pics. This is sort of why there is chance it may not apply here, legally at least. Nakedness and nudity is part of the site. While the private unsolicited dick pics is still a thing, it may not transfer as such due to the nature of the site. Hmm, that's got more than a whiff of the 'she was asking for it' defence when it comes to sexual assault so I'm not sure it would hold water in court. Ok that's not even relatable! Of course it is. It's victim blaming. "She wore this/she's on a swinging site so what does she expect?" Again, it holds no weight when it comes to a pornographic site (not social media). " Other pornographic sites where users can send each other images blur the image and the recipient choose if they view it or not. Fab does not have these safeties in place. Given this change if law it probably would be wise for it to do this.

"To play devil's advocate for a moment - ok, it's a "sex site" but why is the imposition of graphic photos of genitals largely pushed by men onto unwilling women? Man joins sex site. Man is horny and wants sex. Clicks on woman's profile. Woman has tits out, legs open and cock in mouth. Woman has status "mmmm so wet and horny" Man thinks hey up we're in here, sends quick "wow babe you hot, want this?" Along with pic of penis Woman "how DARE you inflict such horror upon my eyes, it burns, IT BURNS!!" Starts protest to burn all penises but not before uploading another vag pic. And repeat. You are reading it wrong. You'd have to show intent to cause alarm, distress or humiliation, OR you'd have to show sexual gratification and recklessness as to whether A, D or H wad caused. " That is what I said the person receiving would have to prove that the person sending a dick pic intended to cause distress.

Here's the thing though. You don't need a phone number to register. Just an email address, which is free to get and not linked to the real 'you' at all. How would the site provide details of an anonymous user? " Your I.P Address everytime you log on?

How they'd go about proving it is another matter but is probably the flip side of the argument "He's on a sex site so of course he's done it for sexual gratification". We are all on here to do whatever with someone's ugly bits. So to claim distress, humiliation etc by seeing images of certain ugly bits would be difficult to establish given the nature of the site, Mrs xxx" As has been said above it's not just about causing distress. The new law also separately covers that the sender has done so for sexual gratification. The 'nature of the site' that you use as an excuse on one hand now becomes a reason for prosecution on the other. My point would be how desperate to send a cock pic would you have to be that you'd want to risk being reported given the potential consequences?

And repeat. " Truth bomb.

" A click to reveal would work I guess, though I'd still click it just out of morbid curiosity. " You've really thought this through. What would have to happen is, by default, all users here would have images/media default to "not visible". A disclaimer box would have to be ticked by anyone who wishes to receive distressing dick documents. Otherwise the only images they could see would be the normal ones. We already classify images here, and these classifications are moderated before being accepted anyway. I don't think the bill discusses websites like this. Plus the government are useless understanding the tech.

"The new law amends section 66 of the Sexual Offences Act 2003. I am summarising, but it says it's an offence to send to another an image, film etc of genitals, if the sending was intended to cause alarm, distress or humiliation. OR The sending was for the purpose of sexual gratification, and the sender was reckless as to whether the sending would cause alarm, distress or humiliation. There is no exemption for sending on a pornographic or sexually explicit site. So from the wording, unsolicited dick (or vag) pics could fall under the new offence. " I thought that would be the caveat harm or distress. So would being on a 'sex site' mean that it would be unreasonable to be alarmed? Or that it would be reckless? Not sure myself about that. Isn't relevant to me, I only send if requested.

It’s naive thinking at best!" It's not like saying a sex worker can't be sexually assaulted at all. I suspect you'd be hard pushed to claim offence at seeing a dick pick in your inbox, on an 18+ site, where you're looking for sex and displaying sexually intimate and graphic pictures yourself, on a site that has literally millions of graphic pictures. Surely it's not unreasonable to expect to see dick pics in your inbox? Equating this to an act of violence on a sex worker because she's a sex worker is a stretch imho. I can't think of any situation where a sex worker could expect to be assaulted. Being on a sex site, full of intimate pictures, having graphic pictures of your own and not expecting to see a cock pick however..... There's a big difference between asking for it and expecting it. For the record and clarity, no-one asks to be, or should expect to be sexually assaulted.

"This is an extract from a UK study on the subject... "Results showed that 76% of adolescent girls surveyed had received a dick pic before and 70% of them had been asked to send naked pictures of themselves before. The adolescent girls shared that most of the dick pics they received were not asked for or wanted but they did not feel they could report it. Many participants shared that it felt easier to simply block or ignore the sender, particularly when the sender was a stranger, and that this was such a common occurrence that it was no longer shocking." " Sobering statistics This bill, once passed - would basically kill off the "British Dick Pic" as it (obviously) wouldn't be applicable on an international basis.

A lot of people have in their profile please don’t send dick pics and still get them sent everyday with normally the caption (suck on this) we don’t have any pics of me sucking cock ect but even if we did that does not excuse being sent some of the most creepy pictures and messages we’ve ever seen. Your views are disturbing and really need to be educated more on what’s correct conceptual behaviour I'm well aware what's correct conceptual behaviour. I'm also well aware I'm on a sex site full of horny men and my inbox isn't gonna be full of cute dogs! Eh Who said that you didn’t ? That’s great you don’t mind that. But as you will see from this post a lot of other people do. " I'm saying I realise where I am.

And repeat. Your views are disturbing and really need to be educated more on what’s correct conceptual behaviour I don't need educating at all thank you. Very judgemental. I've never sent a dick pic in my life. Why people send them is beyond me. Sending a dick pic is the equivalent to walking up to a total stranger in a bar, flopping your wang out and saying "fancy a fuck?" But to be outraged and surprised at seeing a dick pic on an adult site like Fab is naive at best. Simple, don't send dick pics, especially if the profile says don't send dick pics. " when I see statements like yours yes definitely judgmental and happy to be. You’re back tracking now I see because that’s not what you were saying to start with. Hope you keep the latter statement mindset from now on

"given that fab cant trace or verify someone's identity to the police as its all done through third parties it wont be enforceable on here anyway!" But it might even deter the people posting unsolicited pics to stop. Fingers crossed anyway

"Ultimately this ‘crime’ will get treated as a lot of other crimes. You’ll only be allowed to be a victim if you’ve done everything right. Block all men. Say you don’t want dick pics. Don’t be on a sex site. Very similar to the woefully underprosecuted r4pe cases. Don’t wear revealing clothes. Don’t walk alone at night. Don’t be d*unk in public. Etc etc. If your face fits and you’ve jumped through the hoops to make yourself a good victim you might have a chance. Realistically? Not a hope in hell. "

I said nothing, other than a 2 word agreement of an observation. I'm not backtracking at all. I agreed with an observation. That does not mean I agree with an action. You've added 2 + 2 and made 463. The site gives us all the tools we need to avoid the things we don't want to see. Use them. Simple.
