The Chief of Police for Dartmoor has announced capture of a group of cyclists doing nearly 40mph in a 30 mph limit. They were offered words of advice. Would a motorist have got this treatment or would they have thrown the book at him

The police don't always charge every offender, including for motoring offences. We should allow experienced police staff to use their expertise to have flexibility.
Would the cyclists have sped off, like rats from a sack, if they were going to be charged, with the police having no identification details? And possibly a group of cyclists blocking a busy road could have caused a bigger safety problem, whilst waiting to give their details? |

Not a chance a motorist would have got "words of advice",and we have to have insurance,an mot,tax and a licence.How many bikes are road legal?I haven't seen any with an "audible alarm"(bell in old language),Three last night had no lights and two had none at the front.Would you get words of advice if your car was an MOT failure(no horn) or you were driving without lights? |

They do everyone for speeding over the percentage threshold,therefore they would have done a driver doing 40 in a 30,because a 30 is residential/risk to pedestrians. |

I for one would love to hear the coppers excuse for not giving a ticket and points as said if it was a car not a cat in hells chance they would have not been fined and points talk about one rule for one another rule for others.my nephew just been done 1 mile above 3 points yes he was speeding so got what he deserved according to the police. |

Speed limits do not apply to cyclists, only to motor vehicles and their drivers. Dog whistles, what-aboutaries and general hatred towards certain demographics don't have any effect on the law, although I'm sure there will still be plenty of people wasting their time arguing the toss about it and making asses of themselves. |

The "excuse"is lazy policing.Cars have number plates,number plates give names and addresses.Bikes don't have plates and there is no room in lycra fancy dress costumes for a checkable proof of identity.During COVID restrictions the cops had ANPR cars stopping every vehicle that showed as out of area,yet cycling clubs in named area clothing from miles away were just allowed to ride past.Some clubs were openly boasting about 120 mile rides,yet any driver from more than ten miles away had to justify their presence on the road. |

The only people making asses of themselves are those who think rules designed for everyones road safety only apply to some.Most cyclists drive,therefore they have passed at least one test,but ride a bike in a way that would get them fined,points,banned or even jailed if they drove a car that way. |

Cyclists who ride for everyone's safety and obey the rules of the road are absolutely fine.They don't have earphones so they can hear traffic.They look over their shoulder regularly,they indicate,they don't overtake/undertake at traffic lights/road junctions and then force their way in front of you.They have lights at night.On narrow roads and around all corners(highway code) they ride single file,they don't use the roads as their own personal stage of the tour de France.In short they are not selfish,inconsiderate,stupid dangerous c**** |

I did lots of cycling as a kid,road bikes,BMX etc.I'm from the generation that did the Cycling Proficiency Test at school which was compulsory.I cycled to work for two years,used bike and public transport after that for a while.My knees arent quite up to distance riding any more after being wiped out by a moron in a Defender who wasn't looking/indicating.Fled the scene,probably pissed. |

Since legally speed limits don’t apply to bicycles then they wouldn’t get the same treatment, no matter how much we might prefer it. I’m also presuming that e-bikes or steep hills were involved, unless they borrowed Sir Chis Hoy’s legs for the day. |

I did not know that speed limits do not apply to bicycles so in sum of the new 20 mph areas it will be quicker on a bike especially an e bike.. |

Tom, the 2 camps are those that know speed limits laws do not apply to cyclists (it has already been pointed out more than once) and those that don't.
A motorist found not to be breaking the law wouldn't have the book thrown at them, in the same way the cyclists didn't, as they didn't break any laws.
It really isn't that hard to understand.

There’s a difference between a pedal assist bike and an electric motor driven bike without pedals.
The two boys were riding the latter which is illegal as it’s classed as a vehicle.

I suspect that you're not a cyclist...
As someone who rides regularly, I can confirm that earphones don't prevent me from hearing traffic... I can hear more than when I'm inside a car with the radio playing. Riding at 20mph without earphones in, I can just hear the sound of wind in my ears.
Also, a group of cyclists riding in single file are much harder to pass than the same group riding two abreast.

I was followed by a copper when I was doing 90 on the rainford by pass, then 50 in a 30 zone.
I got a talking to, then he checked my speedo for me as it was a grey import, back along the east lancs road.
I got pulled over for doing 70 in a 30 zone on my R6, another bollocking.
Both times no ticket. |

Why should cyclist follow the rules, when there are drivers who don't. We have all seen the idiots on the roads, driving as if they own the road. Totally obluvious to speed limits, the car in front, etc. They have number plates, insurance, driving licence and yet get away with it everyday. |

I would have thought cyclists would want to obey the rules because if they don’t and something goes wrong then they might well die. Just because someone else is incapable of understanding the rules and puts them in danger doesn’t really seem like a good excuse to double down on the risk to me.
If someone (car, motorbike, cyclist, scooter) decides to drive dangerously and they die as a result then I would feel sad at a life lost but I would have no sympathy. |

While there is no speed limit for them they could still under some circumstances be prosecuted using 1988 Road Traffic Act Section 28.
28Dangerous cycling.
(1)A person who rides a cycle on a road dangerously is guilty of an offence.
(2)For the purposes of subsection (1) above a person is to be regarded as riding dangerously if (and only if)—
(a)the way he rides falls far below what would be expected of a competent and careful cyclist, and
(b)it would be obvious to a competent and careful cyclist that riding in that way would be dangerous.
(3)In subsection (2) above “dangerous” refers to danger either of injury to any person or of serious damage to property; and in determining for the purposes of that subsection what would be obvious to a competent and careful cyclist in a particular case, regard shall be had not only to the circumstances of which he could be expected to be aware but also to any circumstances shown to have been within the knowledge of the accused. |

I couldn't believe it as well, it was about 10pm, quiet roads and I riding home enjoying the exhaust note on the bike. Didn't look at my speedo, or notice the copper behind me until the blue lights went on.

A few years ago I got stopped by the police for doing 83 mph in a 50. It was a fine summers evening and it was on a dual carriageway local by-pass. He had me on video and told me the speed I was doing would be an automatic ban. I didn't argue with him although I'd had a god awful day at work. I kept my mouth shut thinking that's my license gone and my living.
He gave me a severe lecture then told me to get on my way and watch my speed in future. He never asked to see any documents or anything.
So, not all police officers are heartless sods.

That wouldn't be an officer being a heartless sod though. That would have been an officer rightly enforcing the law against a dangerous driver.
Having a bad day doesn't justify driving in such a selfish and careless manner. If I believed your account, I'd say that officer should be sacked for dereliction of duty. |

The biggest difference between bikes and cars is mass. The difference between a collision involving a 1.5 tonne steel container, and a 7kg carbon fibre bike is significant
The number of people recorded as being killed in a collision with a bike is tiny, especially when compared to the number killed by motor vehicles... in reality, there are actually considerably more cyclists injured by pedestrians than the other way round.
Having said that, there are loads of terrible cyclists out there who show zero consideration for those around them, just considerably less of them than drivers with the same mind-set... and many "angry cyclists" end up that way due to being constantly harassed, threatened, and abused by car drivers.
On my daily commute, I ride down two 20mph sections of road. I will ride at 20mph on them bits of road but I will always be passed by two or three cars on each of these half mile stretches. |

They have to give a 3mph Grace allowance plus 10% of the speed limit for example 30 mph speed limit - cannot get prosecuted unless doing 37 |

I think we need a survey done on the difference in pain level from getting hit by a cyclist at 30mph and a car at 30mph, it might even be less with the car as you have the chance of sliding over the bonnet and roof and landing with a gentle flop behind where as the cyclist is likely to go straight through you |

The Chief Constable gives guidance to their force on what speed they should look to prosecute at.
They obviously don’t look at every case.

Since legally speed limits don’t apply to bicycles then they wouldn’t get the same treatment, no matter how much we might prefer it. I’m also presuming that e-bikes or steep hills were involved, unless they borrowed Sir Chis Hoy’s legs for the day.

40 feels pretty fast on a bike and would hurt if you binned it. Small contact patch, crappy brakes. Bad idea.
I think my personal record was around 50, keeping up with traffic on a steep downhill.
A puncture doing 10mph put me in A+E despite wearing a decent helmet.
Bike computers (speedo) are generally more accurate than car ones, they are set up with the exact circumference of the tyre. Car speedo's are deliberately set to show a higher speed than you're actually going...

In mainland Europe, motorists are very tolerant of cyclists, it’s why cycling in places like France and Spain is so much fun.
It’s just a shame that many UK drivers aren’t less shit. |

Its a fair point. I think the key word is culture.
I think you can say the same when comparing our cyclists with theirs. Example ive never seen cyclist s in Germany all in black cycling at night with no lights... Or pulling wheelies riding on the wrong side of the road daring and threatening motorists.. Or undertaking buses or cycling on footpaths, jumping lights.... Because they are policed and as you say, have a healthy cycling culture and environment for all roadusers |

No, it improves accuracy. It is an option on every GPS computer I've looked at including the ones used by professionals.

I think that there needs to be a distinction made between cyclists & "people on bikes", there is a world of difference between the teenagers doing wheelies down the middle of the road & the guys/gals commuting to work, or riding for fun & exercise.

Maybe. But using that same thought process. You could say the same about car drivers v person in a car. I think thats part of the issue. Tolerance of twats on bikes and in cars. People on a bike on a public highway need to follow the laws, as do all other road users. As someone above said, a better and healthier respect for the laws and other road users is necessary. Its not going to get any better with the ebikes and scooters and seeming absence of policing apart from speed cam police. |

usually for speeding theres like a 10% grace amount where an officer can use discretion, but given cyclists (not all before anyone jumps on me) you see jumping red lights, knocking wing mirrors trying to pass cars, on mobile phones, riding in the dark without lights you can see why this speeding story is infuriating to motorists.
unfortunately the police do turn a blind eye to alot of cyclist offences even when they happen right in front of them |

Speed limits apply to motorised vehicles so there is no offence of speeding for a bicycle |
