Has anyone ever been successful in legal action based on the paragraph that some people add to the end of their profile? Why do people add it? Surely the GDPR is more appropriate, and applies as statute anyway across the EU and in the UK, rendering the addition of a legal clause pointless. Thoughts? |

People add it because they are sheep.
It just puts me off of a profile to be honest |

This.. I admit I once put it on my profile when I was none the wiser then realised later on it was a load of shit and took up to much real estate on my profile so deleted the text. |

So let's get this right.....who is likely to instigate a civil action in another jurisdiction? There will be no confidentiality once the Australian press get hold of it (assuming that the Sydney University studies were not just an urbanmyth). |

That sounds suspiciously like facts and being vaguely informed.
The kind of people who post those paragraphs aren't into that kind of thing. |

Has anyone actually found that their pics have been used by Sydney University? Do they have a special department that collects intimate pics from swinging websites around the world and if so for what purpose? I really can't quite work out where this has all originated from. |

Clearly those who put it on their profiles haven't read the site FAQ's, which state :
The "legal disclaimer" is pointless nonsense and all does is take up extra space on our servers. Please remove it if you have it on your profile. If you're worried about privacy please set your account to be hidden from non-registered users on your privacy page (this also hides it from search engines but may take a week or two to drop out of search) and remove the notice (and encourage others to do likewise).
Common sense advice would be NOT to put any information on your profile (here, or on any such site) that could identify you or that you don't want to become public! So for your own benefit, don't post phone numbers, real names or email / instant message addresses on your profile that people might see or "Google".
Some people may put non-identifying pics on their public profile but keep face pics private or for friends, for example. |

As commented above, some people are sheep (baaaa). The paragraph has no legal effect and there's the added complication of multiple jurisdictions.
Then there's the "fabswingers is a publicly traded company" bollox that can be found on some profiles, which is clearly ripped from a passage about Facebook
Best option is a nice simple copyright notice. It's a law with international reach.
As for enforcement, that'll be quite expensive, but then the notice is more a warning to keep off the grass so potential photo stealers think twice before they act.

We like the parodies too but if anyone really thinks they are necessary here's a snippet from a law firm...
This is because copyright protection arises automatically once the work is created, so that there is no need for registration. Copyright protection prohibits people from copying your work, distributing copies of it or posting it anywhere on the internet.
....so in effect its protected by copyright automatically. |

There may well have been a grain of truth behind the original claims. Who knows what Universities and Institutions are trawling through websites in the public domain? There's always some social research going on, so it would be more surprising if the site WASN'T looked at in that regard. Just be careful what you post online - it's common sense. |

I found a loop hole that basically allows me to fill suit against the person or site
When you do a Amateur model contract for phub and stuff there’s a box that you tick witch gives phub and your self a rights to distribute your content
Witch means it’s anything you have give them the rights to is now offetvel covered under copyright law
As long as it was on phub before being published on sites
So what you do is sing up for a model contract witch is free
And then crate private gallery’s locked off from public viewing and uplaod everything they first
So if it’s took you can file suit against them as they don’t own the rights to distribute your content

Only if you can show lost revenue for it other wise it’s covered under the fair use policy
And can show a contract for distribution rights
Look in to reaction channels on YouTube they a big war going on
Bweeen YouTube content craters and reactions channels
Whare bascule people react to others content
But because YouTube dose not hold a distribution right’s nothing can be done about it
And we not talking pennys here
We’re talking 2-3-4 million $ per video

Except some sites have it in their T&C's (that bit no one reads) that if you post something you are giving them the copyright. |
