Hi folks, i need a little advice.
I just sold my barbour jacket too a bloke on ebay, nothing wrong with it, sent it off in the wrapper/bag, tags and everything.
35 days later the buyer opens a case against me. He claims the jacket is a fake, so then i prove too him that the jacket is infact real.
He goes on too say he wants a full refund because he "thought" the pockets would be a different shape, although in the photo it showed my jacket.
Ebay/paypal have now put my account too -£188 and i have 4 days too pay it, is there anything i can do ? |

can't quite remember this fully.. but if you don't file a counter case against this person then you will automatically lose on the verdict decision. don't quote me on it. The thing you need to do right now is get in touch with their customer services right now. Be warned the telephone customer line is rubbish and you'll be bounced around departments, but stick with it. They should only have done the refund on return of the item, and not before. You really do need good advice rapidly on this. Making paypal aware is yet another skin on the onion that you'll have to do at the same time.

Have you appealed it?
Would of thought if you proved it's real and had pictures...
Getting a lot of probs on there too at the mo only other way round.
People not sending or refusing to sell for last bid
Have been with them for years and never had problems now nothing but |

We have done each time and the link someone comes up with is always right and helps.

Ebay and similar types of business whilst having own rules must comply with the law in this instance trade desription act. If as you say the person saw via photo the jacket then you did all you can and ebay have duty of care to seller and buyer.
The fact they are giving you a deadline of few days to me on surface of it goes against their own rules and procedures that all businesses have to have in place to resolve issues by investigating all facts not just one side.
Long winded i know but as others say you cannot delay contacting ebay if you cannot get them by phone then email this way there is record you contacted them. |

state ur case, how u had pics and ur description was full and througher.. then say if the guy sends the jacket back u r happy to refund. also point out he never contacted u until he opened the case |

We use e bay a lot and had a few problems, phone them as if your item was as advertised its binding and his hard luck, if u don't contact them they will rule in his favour, as long as it was as stated in your ad and pics was correct then it's his problem not yours, they think it will scare u to refund when rules state refunds are only when u mid lead people, hope this helps |

Hi, so long as you have given all correct information in your selling details and can prove it is a genuine barber I fail to see what grounds the buyer has to complain. Try explaining to e bay that you have sold it in good faith and that you have physical evidence of the jacket being genuine. Hope your problem is resolved in due course. |

I had problems with ebay once and i would never use them again
I sold my iphone 4 on there when i upgraded
The phone was only a few month old, always lived in a flip case with a screen protector on and was in as new condition, not a mark on it
It sold for £330 and i posted it off, a few days later he mailed me saying the phone was not as described and wanted a refund, i gave him my address and he send it back, the phone i received was not the phone i sent, he sent me back a phone with a broken screen, i mailed him saying this wasnt the phone i sent and i would not be refunding him as he was obviously pulling a fast one to get a new phone to replace his broken on, he never replied but opened a case against me and paypal refunded his money in full, so he got my perfect phone and his money back, i mailed ebay but they said all i could do was open a case but i would need proof the phone he sent wasnt the one i posted out, i sent them copies of the EMI number, they mailed him and asked for the EMI number but he just sent a\ faulse one to which ebay mailed me and said the numbers didnt match so there was nothing they could do
ebay is great for protecting buyers but they arnt much use when people do things like this for protecting sellers |

Just remembered this, and thought it useful...
If you're on the helpline (phone) then ask who you are talking to each time you get handed around a department. Ask for a direct email address to that department for key people they do have them, and will give them out if asked.
Same goes for paypal virtually. Get paypal notified ('scuse caps) YESTERDAY!

It's possible that the guy is trying to pull a fast one. He might send the jacket back to you, but it might not be the one you sent him in the first place. Unfortunately there are some unscrupulous characters on eBay who do such things.
If the jacket is genuine and you have documentation to prove its authenticity then that should be sufficient to support your case.
It might be that the guy has simply changed his mind and is looking for a refund by accusing you of supplying fake goods. |

Hubby sold a model car through ebay a little while ago the buyer then opened a case sayibg it was badly packaged and broken when it arrived with him
Hubby opened a counter claim sending all the pics and asked everyone else he had sold to within a month to confirm how well things were packed ebay contacted all the other buyers and Royal mail and found the case was not proven by either party hubby got his money for the model buyer got a refund and the model and they do have a generic name which says the item was A+ etc
It did take some time to finally end it but was worth it in the end xx |
