Had an Accident?

Working from home today and have to confess to switching the TV on in the background. Then turning it off after 20 minutes!
Not a regular watcher ofdaytime TV - but can't help notice the sheer volume of ads promising you thousands in compensation for your "accident"!!
Now i've just checked in the dictionary and found this definition.
"an undesirable or unfortunate happening that occurs unintentionally and usually results in harm, injury, damage, or loss."
The key word to me here is 'unintentionally'. Surely if this is the case then there is no-one to pursue for damages? If there's no intent - is there any blame?
I'm a firm believer that the 'compensation culture' from over the pond has had a severely detrimental effect to society over here. Accident solicitors have become nothing more than amulance chasers, promising cash for your misery, whilst making themselves a tidy profit in the process. The only losers it seems are those paying ever increasing insurance premiums - largely those that wouldn't dream of fudging an insurance claim, or sueing someone who intended them no harm just to make a quick buck!
I know it's not official 'Rant' day til tomorrow - but i'd love to see these adverts banned from the TV - if there's a genuine need for legal action i'm sure people can find themselves the appropriate help without being encouraged into claiming for every bruised knee or dented ego.
And don't get me started on pay day lenders! Grrrrrrrrrrr!

That pisses me off too!
Next thing they'll be hanging around the door handing out business cards like they do in shopping centres!
I had great fun the other day winding up one of those - told them about a nasty accident i'd had resulting in whiplash and time off work/loss of earnings (all pure fiction!) - you should have seen them drooling and reaching for forms!!
They kind of shut up when I explained later that it was a van with their logo on that had caused said ficticous accident! |

I can understand this!!
For example - I predict that if you were to stroll down your local high street whilst wearing your wonder woman knickers, drop something and bend to pick it up - there may be the odd predictable accident in a few male OAP's Y-fronts!
Avoidable - simply by not going out and instead staying home and shagging all day!

I can understand this!!
For example - I predict that if you were to stroll down your local high street whilst wearing your wonder woman knickers, drop something and bend to pick it up - there may be the odd predictable accident in a few male OAP's Y-fronts!

Some blokes in a van yesterday nearly caused an accident, I was walking across a zebra crossing, they were two cars behind and repeatedly beeped the horn at me and shouted a few things, the other drivers were not happy.

Whilst I agree that these adds are disgraceful and should be regulated, some of these companies are good.
They do provide a route to seek assistance in obtaining legal advice in a situation where they may be entitled to some form of compensation. The cost of such advice may be out of the reach of some, without these companies being around.
The idea of liability insurances are there to pay out in the event that it can be proven in a court of law that you were a victim of someone's negligence.
For axample your definition of accident is true. However if I drive into the back of you, I may not have done it deliberately to hurt you, but I have been negligent in not driving far enough behind you to allow me to stop safely without colliding with you.
Therefore why should someone not be compensated for their loss of earnings, and cost of rehabilitation?

Well the ground was flat, so not possible.
After 5 years I got compensation, only because the company I used proved the driver to be a complete liar, she made up other things.
So in my eyes, this may have been an "accident", but it was intentional as she was driving without due care and attention. |

Surely driving too close, on your phone - or generally in any 'negligent' way - means the resultant incident was not accidental, but caused by someones inability to act in a proper manner whilst driving?
Uncontrollable incidents - a black cat running in front of you causing you to swerve/brake, a tree fall, a bin liner blowing across your windscreen blocking your vision - these are true 'accident' causing occurrences.
Funny how when there's no-one to sue - these "Accident Claims Specialists" can't really offer a lot of assistance!! |

Based on your definition of accident, it is still an accident, as they never intentionally set out for it to happen. They wouldn't have got in to the car thinking I'm gonna drive into someone.
The part of the policy you are claiming against is the liability section. This section is designed to "indemnify you against claims from a third party as a result of loss and or damage to third party property or persons, following an act of negligence"
They can only help when there is someone to blame, as that is their service. Many will tell you if they don't feel there is a claim. |

And having had first hand experience of such 'services' - many have no qualms at all about suggesting you're injuries/losses were far more serious than they were - and that there's no negative impact on the poor souls who accidentally rear-ended you - just their insurance company.
Which effectively means all those honest folk out there whose premiums go through the roof each year despite another years no claims bonus.
