Just asking this here as someone may know. Just need a quick answer
Some one took photos inside my business but then used them to promote another business. The person in the photos claims they are his property to do what he wants with, but I really don’t know my rights on this as yet. I don’t want photos of my business to be used to help my competitors |

Did you give permission for the photos to be taken?
He is right insofar as he has copyrights to the images. The crux of the issue, was permission given/or not before they were obtained. I would imagine that advertising standards are also at play. Do the images portray a false image of his own business. |

As far as I am aware of the photos are inside you Business they have no rights to use them as long as you can prove they are of your business.
I have this a few years back but they removed them when asked.
Legally I’m not sure there is much you can do though |

To be more specific , photos were taken inside a bar i co own. But another bar is using the images despite it being my bar in the photos. The person in the photos was modelling for a designer brand. But my bar is in all the flyers |

I don’t know anything about the law on these matters.
That’s some kind of industrial espionage though and that makes them spy’s which I believe it’s perfectly legal to assassinate.
The Russians use polonium-210 but you’re free to use any method you choose. |

Unfortunately it looks like they can take pictures if it's deemed a public space. As for the advertising it as their place though, I'm sure that would come under false advertising at best, maybe defamation at worst if people mix the two businesses up because of it.

They are his intellectual property but you have 2 grounds for civil claims, both loss of revenue , it’s going to be complex is it worth it and are you prepared to calculate your losses from his actions ? You will need to and justify them to his legal then settle out of court |
