Cop is claiming I was on my phone. I wasnt. I was stopped in traffic had a look at my wallet while waiting. He's no saying as my phone was in my drivers door I had to have been using it

Garda sargent no good to u u have to be an inspector now to quash penalty points u could challenge it in court but extra points and fine if unsuccessful

Instead of paying fine go to court. Bring your phone bill with you. Garda will have date, location, time etc; of alleged offence. Produce your phone bill showing no activity on your phone at that time. Explain to judge it was a honest mistake on the gardas part (no point in making him look bad, it'll come back to bite you) & it should be fine (pun intended )

That wont prove anything. Any app could have been open that wouldnt show up on a phone log

A forensic phone screening report will tell you everything about your phone - second by second if needs be - including all app's being used.

Also, be sure what you say is concise. Get as close to bench as possible. Ensure you speak with clarity as most DC Judges will give you a ten second window and that will be on a good day

Should be struck out if the Garda appears!

No justice in District courts, once saw a man in court for same reason and Garda said he had drove by him on his phone, man stated he has hands free kit so he never has to hold phone.

No evidence from Garda just he said , he said but he was found guilty and fined.

Go to court and contest it, tell them you want full disclosure of evidence/ book of evidence (bits called a Gary Doyle order, based on the State vs Gary Doyle, google it) before you give a plea of guilty or not guilty.

There's a chance if you stick to your guns they may drop it.
