They are cakes. It was discussed on QI. A biscuit gets soft when it goes stale and a cake gets hard. So therefore they are cakes.
To prove this they made a cake sized Jaffa cake. (In essence a huge Jaffa cake)
And now I want one. |

The courts in the uk decided jaffa cakes were cakes. Chocolate covered biscuits were classed as a luxury and liable for VAT,where
cakes were classed as a necessity and exempt from VAT. As the couple pointed out up above, a 12 ft jaffa cake was made and it was said that when biscuits are stale,they go soft. When cakes are stale they harden. Theres some useless info i thought you might like  |
