I just read article in prominent Irish newspaper where man was released released from a charge of apparently raping a 12 year old in the UK who claimed and was said to look older. It once again brings the old subject of political correctness v the harsh so called reality of life to my mind. I often struggle morally between the two. If anyone else has read this any thoughts.

is this where he pleaded guilty but the judge agreed she looked over 16 ???and the judge was a woman. It's blooming disgraceful this was a minor but the assault happened even not taking the age into effect and he walks away the mind boggles.

I think it's a bit more complex than that. The issue of deliberate deceit on her part comes into it and the issue of whether that that deceit could be believed also. Also it poses the question is a minors actions if carried out to put another at legal peril above legal responsibility.

Haven't seen or read it, but still assault and underage. Wouldnt be the first time this sort of thing happened and people with the right type of power, get off Scot free.

I agree 12 yr old don't look older than 17 or 18. I read the case in the UK, but still sex took place under the age of consent. In this case he's totally wrong for letting sexual contact take place...not even mentioning if he did sexually assault her...

If there were people passing her by not realising she was 12 years old, id say she blended in with whats considered normal attire for young girls these days. Nobody stopped to ask her what she was doing there at that time of night. If that young lad was on a night out and drank alcohol, then how was he to know her age either?

I wondered all this too but where does the responsibility lie is question I just find hard to understand. She is considered a minor but was giving impression was older maybe on purpose.

The responsibility lies with her parents for allowing her into that position in the first place. Im not surprised the judge ruled it an exceptional case when all these factors were against the young girl. Shes a minor and her parents should have been more vigilant with her whereabouts. Theres no excuse nowadays for checking up on kids when theyre not home.

Sorry but we've all done stupid things when we were younger. Like saying I'm staying in so and so house but in reality you're in a field drinking. Or similar circumstances.

We don't know the details of where she said she was or what her parents were doing etc so I don't think they can be held accountable.

She purposely lied about her age and now this man is paying the consequences for her actions.

Shops and pubs should be held accountable for selling her alcohol (if they actually did) without ID though.

Her parents are accountable. Shes a minor for heavens sake! And whats wrong with phoning other parents to check and make sure shes staying the night if shes staying in a friends house? A 2 minute phone call would put that to rest. Kids and teens will chance their arm more nowadays than years ago. Parents should up their game and stay one step ahead to protect theur kids instead of potentially putting them in harms way.Thats what happened here and theres absolutely no excuse for it.

her parents are accountable for where she is maybe this time her parents took her word she staying at a friends house and vice a versa....we don't know the inns and out of her parents actions on the night in question. I would like to think they did have there daughters best interests at heart until I know more in my opinion you can't blame the parents.... im sure the outcome they did not forsee...

I remember reading a case similar to this where a guy was arrested and charged with having sex with a 14 year old girl he met in a nite club. She turned up to court wearing her school uniform, no makeup.

His barrister had three requests:

1. She had to wear the clothes she was wearing on the night in question.

2. She had to apply the same makeup she had that same night.

3. Ask her to produce the ID she used to gain entry to the over 21s club.

4. Wanted to know why she was allowed into an over 21s club.

The judge deferred the case for the following day and when she turned up to court as requested the jury found him not guilty of due to deception on her behalf.

I've worked in door security and constantly see this type of think over dressed young girls done up to the 9s looking far older than they are.

Not saying he's completely innocent as I haven't read the case but maybe there is an argument for deception.

No relation to the case, I find it hard to believe he hadn't even a seed of doubt as to her age... 12 years old come on!

Just read this story on bbc Web page. It's a very complex case but going by the details given I understand why the judge let him off with no charge. Yes the girl was only 12 but said she was 16. The police (who were looking for a missing 12 year old that night) spoke to her in the early hours and had no concerns for her age. The taxi driver said she looked 20. The judge has looked at cctv footage and has admitted the girl looked older than her age on that night.

For the media to call him a rapist is, in my opinion, wrong.

This is from the ruling:

The fact that all the witnesses that night were of the opinion that the victim was older than 16 years – with impressions ranging between 17 to 20 years of age given.

In particular the assessment of the police officers who had no concerns about the victim’s age, in the context of having spoken to her at some length and at a time when they specifically looking for youths who were too young to be out and about in the streets.

For what it is worth my impression from viewing the victim on the CCTV footage on assessment by appearance that the victim was over 16 years of age would be a reasonable one.

The context of meeting the victim in the taxi queue at 4am, after she had purchased and drank alcohol and whilst socialising with other older teenagers.

The fact you were told she was 16 years old.

Her willingness to go to the flat to party and when she got there to engage in consensual sexual activity with you, in which she was an active participant.

The absence of any suggestion the victim was distressed or concerned at any time.

As far as I know (but correct me if I'm wrong....I'm only a mere woman at the end of the day) feminism is defined by equal rights and opportunities for both sexes. It's all coming from the states and has infected our media since we've started adopting American culture much faster than before.

My own motivation for pointing out its pitfalls come from the absolute shock of meeting as girl who was 1 million percent convinced that 25% of men are rapists by various feminist media sources. Before that I couldn't care less.

In her world view, this was as undeniable a fact as creationism is to hicks in the bible belt.

She has obviously been misinformed by what she has read/heard and is in the minority. Classing all feminists the same way is akin to branding all Muslims as terrorists/all priests as kiddy fiddlers/all ginger haired people as Irish (sounds stupid but you can see what I mean)....stereotyping a group of people on something that the minority are/have done. It's like any walk of life - there's the fanatics that ruin it for others, or the people who believe the sky is green because 'I read it somewhere so it MUST be true)

Have to agree with the general consensus here Flash. I'm not a regular visitor to the forums and even I have found your complete abhorrence of feminism a little repetitive, boring and one dimensional. You're entitled to air your views but the sledgehammer treatment is dull.

Who are you to say 'here and no further?'. The historic oppression of woman in this country is horrid. You wouldn't be enjoying much of a sex life if it wasn't for feminist movements, birth control etc etc. Yes some extreme feminists may have Uber aggressive views but generally there's still plenty need for feminist movements both here and around the world.

Historically of course, amazing things have been achieved.

It's not abhorrence, I have huge respect for some aspects of it but I also have abject horror for some the uglier and more vocal elements.

In the modern day western world we are in the realm of diminishing returns which carry societal costs.

There is still some serious work to be done in other parts of the world.

Drinking alcohol going back to a party.. but she claiming she was assaulted.At the end of the day a minor and she still is, is claiming that this happened to her....

She told her sister in case she might be pregnant. Now while i feel so sorry for the young child, cos thats what she is, a child, i cant help but feel utterly pissed at her parents. Doesnt matter if she looked 16, she was 12 and should have been under the watchful eye of her mum and dad in her own bed. Instead she was d*unkenly wandering the streets at that hour of the night. The parents should be prosecuted for neglect.

Sorry but we've all done stupid things when we were younger. Like saying I'm staying in so and so house but in reality you're in a field drinking. Or similar circumstances.

We don't know the details of where she said she was or what her parents were doing etc so I don't think they can be held accountable.

She purposely lied about her age and now this man is paying the consequences for her actions.

Shops and pubs should be held accountable for selling her alcohol (if they actually did) without ID though.

Her parents are accountable. Shes a minor for heavens sake! And whats wrong with phoning other parents to check and make sure shes staying the night if shes staying in a friends house? A 2 minute phone call would put that to rest. Kids and teens will chance their arm more nowadays than years ago. Parents should up their game and stay one step ahead to protect theur kids instead of potentially putting them in harms way.Thats what happened here and theres absolutely no excuse for it. "

The child's parent or parents should have been absolutely certain of where their daughter was, and there's no way in hell a child her age should have been out at that time. She clearly knew what she was doing, and was in no way distressed by what happened, which suggests to me it wasn't her first time. Everyone who came into contact with her on the night thought she was much older, the poor unfortunate man was no exception.

I think the judge was right in her decision, but I think each case must be looked at individually, and I don't think this decision sets a precedent or makes it easier for someone else to have sex with a minor and get away with it.

Drinking alcohol going back to a party.. but she claiming she was assaulted.At the end of the day a minor and she still is, is claiming that this happened to her....

She told her sister in case she might be pregnant. Now while i feel so sorry for the young child, cos thats what she is, a child, i cant help but feel utterly pissed at her parents. Doesnt matter if she looked 16, she was 12 and should have been under the watchful eye of her mum and dad in her own bed. Instead she was d*unkenly wandering the streets at that hour of the night. The parents should be prosecuted for neglect.

Sorry but we've all done stupid things when we were younger. Like saying I'm staying in so and so house but in reality you're in a field drinking. Or similar circumstances.

We don't know the details of where she said she was or what her parents were doing etc so I don't think they can be held accountable.

She purposely lied about her age and now this man is paying the consequences for her actions.

Shops and pubs should be held accountable for selling her alcohol (if they actually did) without ID though.

Her parents are accountable. Shes a minor for heavens sake! And whats wrong with phoning other parents to check and make sure shes staying the night if shes staying in a friends house? A 2 minute phone call would put that to rest. Kids and teens will chance their arm more nowadays than years ago. Parents should up their game and stay one step ahead to protect theur kids instead of potentially putting them in harms way.Thats what happened here and theres absolutely no excuse for it.

The child's parent or parents should have been absolutely certain of where their daughter was, and there's no way in hell a child her age should have been out at that time. She clearly knew what she was doing, and was in no way distressed by what happened, which suggests to me it wasn't her first time. Everyone who came into contact with her on the night thought she was much older, the poor unfortunate man was no exception.

I think the judge was right in her decision, but I think each case must be looked at individually, and I don't think this decision sets a precedent or makes it easier for someone else to have sex with a minor and get away with it. "

Iv seen some girls go out to nite clubs with the mother's and to be to be honest its hard to tell sometimes you would think they we're sisters that Monday you would see the daughter going to school never the less underage thats what it is but deceit has to be looked at

They could still be the age of consent though...you can still be in school uniform when you're 18 and the age of consent is 16 or 17 dependent on where you live.
