If a particular company was to transfer money into my account in error (quiet regularly) and i say nothing and spend the money and somewhere down the line they were to realize it was an error on there part? Are they within there rights to come after me or is it tough shit on them??

Was a case a couple of weeks ago in the paper
A woman had 25 grand put in her account by the banks mistake. She spent it and ended up in court

The money isn't coming from anyone's account though. That's the thing. It comes directly from the company themselves so nobody can possibly report it because nobody can kno about it. The only way would be if they looked at my account and said wait a minute, how is there that much money in that account so quickly. |

Bare in mind this has happened around 3 times over the last 2 and a half years. First time was for like 300 odd euro. Second time 680 and tonight almost 3 grand lol

If its social welfare etc, they will vet it back,
A case last year of a guy who got over paid for a "month" 20yrs ago, they took it back out of his state pension, when he retired,
A gardai got auspended, fined , for scamming ATMs, he would key in €400, but only taking half out of the drawer, the door closes after a certain time, and he claimed off the bank, the bank noticed then he was pitting his card in again and keying in €200, that would pop out plus the other 200 he left behind.....he always had a witness, and of course, who wouldn't believe a guard, the bank copped on after a few times... |

Iam surprised myself tbh. Gonna look in to it further before i contact them and open my mouth. I really don't see how they are gonna cop the error though unless i bring it to their attention. This isn't anything to do with the banks like. If it was then i wouldn't stand a chance |

So you must be claiming for something that you know has already been paid to you...otherwise you would just have whats owed...its your actions as well as a computer error thats getting you the cash...can't see you not having to pay it back...

although in a job i was in, we had a contract with the Dail, with monthly standing order of product, they changed supplier, but for 3 yrs after we got paid, the bank transfer stopped, didnt hear a thing from the Dail, or the finance dept |

As far as I am aware with UK law it is still classed as theft, all money will have to be paid back with some cases adding interest and court costs.
With the addition if having a criminal record on your plate and possibly losing you current job and not obtaining work long term in the future, there has been dozens of these cases throughout the UK since 2002 available on public record.
Do some research on it freedom of information act.
Even if it takes until the tax year they will notice.

I do believe if it were a bank or other financial institution they would be entitled to repayment. If it were a company say lodging someone's paycheck into your account then they would have to sue you. Make an offer of 50% back (just make sure you keep 50% in the account.) |

Just a matter of time before its noticed by the Company. Once an investigation takes place, there is a paper trail of all transactions. .. paper or electronic.
I've seen cases where this has come to light and the customer has had to take out a loan to repay. |

Unfortunately for you its theft. You are obliged to notify the sender and your bank in writing soon as you realise. You are probably entitled to charge for your time in arranging to reverse the transaction but nothing more |

Just contacted a lad i kno that deals with this type of thing and he told me that given how the money was applied, iam not obliged to say a word. If it was a case of an actual transaction from one account to another then it would be different. None the less i called the company and explained the situation. Waiting on a call back from management |

I work in the banking world and it is 100% recoverable. Once it's noticed all payments can be recalled without notice. Any funds not recovered you can be taken to court over and then enforcement proceedings can be taken against you.
Enforcement proceedings include a payment order and if you default the sherif can be ordered to come to your home and seize property if you don't have the funds to pay.
If you own your home they can obtain a judgement mortgage against you whereby a lien is put against the property. If you sell the property after your mortgage is cleared they will be paid, they can also petition the court for you to sell your property to clear the debt remaining |

I work in the banking world and it is 100% recoverable. Once it's noticed all payments can be recalled without notice. Any funds not recovered you can be taken to court over and then enforcement proceedings can be taken against you.
Enforcement proceedings include a payment order and if you default the sherif can be ordered to come to your home and seize property if you don't have the funds to pay.

I work in the banking world and it is 100% recoverable. Once it's noticed all payments can be recalled without notice. Any funds not recovered you can be taken to court over and then enforcement proceedings can be taken against you.
Enforcement proceedings include a payment order and if you default the sherif can be ordered to come to your home and seize property if you don't have the funds to pay.
If you own your home they can obtain a judgement mortgage against you whereby a lien is put against the property. If you sell the property after your mortgage is cleared they will be paid, they can also petition the court for you to sell your property to clear the debt remaining

Just remembered a few months back that an employee at a bank filled the ATM machine up for the weekend and accidentally put 50's in the 20 euro slot. So you got 100 if you looked for 40. The queue at that ATM lol and balance only stated 40.
I know it's different but had to share. |

No idea, it didn't happen to me. Got a phone call from a friend that was in the queue giving me the low down. They went straight to the pub. I assume the employee got in trouble for that mistake. |

If you sought legal advice from a solicitor he should be struck off. It is a criminal offence under sectiom 2 of the theft act receiving goods or services under a false pretence. You can act johnny big balls all you like. You will be charged with theft, tried in the circuit court and found guilty. Sín é |

It's happened plenty of times, the banks are securely holding your money. If you take out and spend money that isn't yours then you are liable for it.
If you get the wrong amount given to you from an ATM you need to report it. Most idiots though think they've won the lotto and keep making withdrawals and then moan when the bank eventually debits them the correct amount and the people end up in debt and overdrawn |

I do believe if it were a bank or other financial institution they would be entitled to repayment. If it were a company say lodging someone's paycheck into your account then they would have to sue you. Make an offer of 50% back (just make sure you keep 50% in the account.)
So it's OK to steal once you give half of it back ??"
