Yes that's why you don't get any fake profiles in other countries where those laws already exist

Given our lax sentencing here i cant see anyone serving 7 years. Discord are looking into what happened and so are the gardai but it shouldnt have had to take what happened for the legislation to have been properly brought through.

Yes - because that's what the PROPOSED laws are for.

"What are the new laws ?? "

Proposed laws that anyone caught sharing photos without explicit consent of the other party will be subject to criminal charges. This will also be extended as regards "revenge porn" even if the pictures at the time were taken with consent, if the other party shares photographs to cause malicious and wilful harm then they will also be subjext to criminal charges. These will include fines ans up to 7 years imprisonment

Therein is the first problem;

Once again I think you're misinterpreting what these laws are proposed to counter against

Im not sure how comprehensive the proposals are. Ireland is still very behind as regards cyber crime. These proposals have been in the making since last year. Obviously the previous government didnt think they were a priority.

Hopefully these proposals and ones with regards to cyber bullying will be in effect soon. However IMO the justice system needs a complete overhaul with regards to sentencing, more often than not the punishment does not fit the crime. I hope the propsals are very comprehensive and detailed but tbh i would hazard a guess that many a slapped wrist fine will be handed out as opposed to jail time

Also just in response to that, they have stated that will not be a defence and publication/distribution without intent to cause harm will result 12 month prison term and/or 5,000 fine

Excellent. Thank you....

But I honestly can't see it becoming an enforceable law/offence.

Maybe I'm just too cynical, but in a country where a man can defend himself against a murder charge by stating he didn't MEAN to kill his wife by staving her skull in with a brick I don't have much faith in the legal system.

Agree which as i stated above the justice system needs an overhaul. Mandatory minimum sentencing for serious crimes. People who arrest sheets as long as their arms should not be on the streets. Given that men who have shared minor related content and received suspended sentences is not a good sign so i think this would be where the mandatory sentencing would come in. To me this isnt going to protect anyone only line pockets

Google Dara Quigley and you will soon find why the gaurds and DPP have had little interest in taking this on. These laws will be pushed back time and time again as they have been over the last 7 years. Don't get your hopes up and please be very careful who you send face photos yo

Cant see anybody facing 7year for cyber bullying but it's the stealing of other people's pictures that's absolutely rife on this site, wondering will it stop it. Remains to be seen

Publication/distrubtion of pictures with malicious intent to cause harm will carry a sentence of up to 7 years. Cyberbullying is seperate proposal altogether. As regards picture stealing here, it will be up to the individuals who had their pictures stolen to report the matter to the gardai if and when the legislation admendments are brought in

"stealing" pictures is not possible.. If an image is publicly uploaded then it's fair game to be downloaded.. Why wouldn't it be??

Surely if people didn't want their images to be downloaded then they wouldn't upload them publicly..they would keep them private.. Suppose it's like leaving the front door of your house wide open and expecting it not to be robbed??

Even if the front door is open it's still illegal to enter and steal anything so you analogy is wrong.

Of course it's illegal point im making is if people are stupid enough to take pics like this and even send them to people they can't be surprised if they end up on a porn site.. They have to shoulder some of the blame too.. If there was no sexy pic there would be no problem..

My friend you have just perfectly illustrated the problem with victim blaming;

"Well if you didn't have that car it wouldn't have been robbed!"

"Well if you didn't chew so loudly you wouldn't have been stabbed!"

"Well if you just stayed at home you wouldn't have been mugged!"

The problem lies with the one who commits the illegal act, not with the victim.

Hopefully it will stop revenge porn

Also it might make people stop and think before they send pics,

Mainly teenagers who might feel it's pressure to send them
